TERMS AND CONDITIONS

CLASSIC CATCHES- ENTER FOR YOUR CHANCE TO WIN A JAYCO CROSSHAUL PROMOTION (“Promotion”)

  1. Information on how to enter and prize details form part of these Terms and Conditions. Entry into the Promotion is deemed acceptance of these Terms and Conditions.
  2. The promoter is iFish PTY LTD. (ABN 68 074 986 717) of 270 Sth Gippsland Highway, Cranbourne, Victoria, 3977, telephone number 03 359966500 “Promoter”).
  3. Entrants must be over 18 years old and live in Australia.
  4. Directors, management and the employees of Jayco Corporation Pty Ltd, 1 Jayco Drive, Dandenong South, VIC 3175 (ABN 79 301 936 497) (“Prize Supplier”) or the Promoter, retailers and suppliers associated with this Promotion and the immediate family members of those individuals are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st
  5. The Promotion will commence on 29/04/2021 and final entries close at 11:59pm AEDST on 25/07/2021 (“Promotional Period”).
  6. To be eligible to enter, individuals must, during the Promotion Period: i) Complete the competition form at jayco.com.au/ifish ii) Answer the following question in 10 words or less ‘‘The first place I would adventure in my new CrossHaul is…’ as part of the competition process.
  7. Multiple entries in the one Promotional Period are not permitted. To avoid doubt, entrants may enter the Promotion once in each of the Promotional Periods. Incomplete, indecipherable or illegible entries will be deemed invalid.
  8. The winner of the Promotion shall be judged by the Promoter to have the most creative answer. The Promotion is a game of skill.
  9. The judging will take place at 9:00AEDST on Thursday 29th July, 2021 at Jayco Corporation Pty Ltd, 1 Jayco Drive, Dandenong South, VIC 3175. The winner will be notified by phone and email and announced on the website jayco.com.au/ifish.
  10. There will be one winner of a Jayco CrossHaul including twelve (12) months vehicle registration and dealer delivery charges (through local dealer) – costs may vary State by State. The winner will be liable for all other costs. Total prize value is up to $27,600. Prices and inclusions are correct at time of print but are subject to change at the discretion of Jayco Corporation. The prize is not transferable or exchangeable and cannot be taken as cash.
  11. The prizes will be delivered to the winner’s local dealership and must be collected from the advised dealership, this cannot be changed. Delivery timeframe may be varied at the Promoter’s discretion, including due to business operating times and holiday season. Standard Jayco Caravans warranty conditions apply. The winners will need a valid Australian driver’s licence and a legally compliant and fit for purpose tow vehicle when collecting the prize. The winners are responsible for organising insurance before collecting the prize. Vehicle will be registered in the winner’s name. The Prize Supplier will assist with the registration process and provide in advance the details required to legally achieve registration plus any other legal requirements that must be satisfied. Only once all handover requirements have been fulfilled, will the winner be able to collect the prize. The Promoter is not responsible for and will not provide the winners with additional options and ancillary costs, including (but not limited to) petrol, modifications, insurance, transport, body, paint or mechanical damage, or any other costs or damages.

If the winner is, through any legal incapacity or otherwise, unable to register the van in their own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter and Prize Supplier take no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the prize is awarded. It is a condition of accepting the prize that the winner (or a representative of the winner) may be required to sign a legal release in a form to be determined by the Promoter in its discretion.

  3. The Promoter’s decision is final and no correspondence will be entered into.
  4. If the prize is unavailable for any reason, the Promoter reserves the right to substitute another prize of equal or greater value and specification for that prize, subject to any directions from a regulatory authority.
  5. Subject to clause 21 below, if for any reason the winner does not take the prize by the time stipulated by the Promoter, then the prize will be forfeited.
  6. If the prize remains unclaimed by 9:00am AEDST on 2/08/2021, re-draw may take place at 10:00am AEDST on 3/08/2021 at the same place as the original draw, subject to any written directions from a regulatory authority. In the case of a winner, they will be notified in writing and by telephone within two (2) business days of the re-draw and the name of the winning Eligiblewinner will be published on www.jayco.com.au/ifish from 9/08/2021.
  7. As a condition of accepting the prize, the winner consents to the Promoter and the Prize Supplier using the winning Eligible Business’s details and their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter and the Prize Supplier.
  8. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to pandemic, technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
    • to disqualify any Eligible Business; or
    • subject to any directions from a regulatory authority, extend, suspend, terminate or cancel the Promotion, as appropriate. 

  9. Any cost associated with accessing the promotional website is the Eligible Business’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Business to automatically enter repeatedly is prohibited and will render all entries submitted on behalf of that Eligible Business invalid.
  10. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
  11. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an Eligible Business or authorised representative; or (f) taking/use of a prize.
  12. As a condition of accepting the prize, the prize taker must sign any legal documentation as and in the form required by the Promoter and/or the Prize Supplier in their absolute discretion, including but not limited to a legal release and indemnity form.
  13. The Promoter is bound by the Australian Privacy Principles contained in the Privacy Act (Cth) 1988. A copy of the Promoter’s privacy policy can be viewed at https://www.ifish.com.au/pages/terms-and-condtion. To request access to, or to update or correct, personal information the Promoter holds about them, authorised representatives of Eligible Businesses can contact the office of the Promoter at the address set out in clause 2 or view the Privacy Policy for instructions. The Privacy Policy also contains information about how authorised representatives can complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, Prize Supplier and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may also, if the opt-in box is ticked at the time of Registration, for an indefinite period, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the authorised representative. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
  14. With an Eligible Business’ express consent to do so, the Prize Supplier will handle entrant’s Personal Information (as defined in the Privacy Act 1988 (Cth)) (e.g. first name, last name, address, suburb, state, postcode, phone number, email address, gender, date of birth) in accordance with their Privacy Policy which can be accessed at https://www.jayco.com.au/promo/privacy-policy. Jayco Caravans’ Privacy Policy may be updated from time to time and it will be the entrant’s responsibility to keep up to date with any changes to the Privacy Policy. An Eligible Business may at any time, opt out of receiving contact from the Prize Supplier by submitting an enquiry on the Contact Us page of the website jayco.com.au.
